Without limiting the generality of any other section of this Agreement, Obvi reserves the right to limit or refuse any purchase you place with us.

All purchases are subject to verification by Obvi at any time and for any reason. We reserve the right, in our sole and absolute discretion, to require proof of identity (in a form acceptable to Obvi: (i) for the purposes of verifying the legitimacy of any purchase and/or other information; and/or (ii) for any other reason we deem necessary, in our sole and absolute discretion, for the purposes of fulfilling an purchase in accordance with our interpretation of the terms and conditions of this Agreement and/or the specific terms.

Currency, Taxes, And Additional Charges

All prices and rates are in Canadian currency, unless otherwise expressly stated, and are in effect at the time of publication only and are subject to change without notice. Obvi reserves the right to change any price, rate or fare without notice at any time prior to date of purchase.

In accordance with appropriate regulations, Obvi may charge you a fee or service charge for products sold by Obvi or services performed on your behalf by Obvi, in addition to the insurance premium otherwise listed on the Obvi Website. These fees or service charges may be for, but are not limited to, premium financing, policy placement, document review, account setup or other reasons. We reserve the right to amend our fees & service charges at any time, but these fees will be disclosed where appropriate on the Obvi Website as part of the quoting process.

Unless otherwise expressly stated, all prices exclude all applicable sales taxes, tariffs, excise, and any other taxes or surcharges which may be imposed on Obvi.

Cancellation of Access

We may at any time, without notice, restrict or cancel your access to the Obvi Website if we reasonably feel that you are conducting improper or illegal activities on the Obvi Website.

Third-Party Social Media

Obvi’s use of social media serves as an extension of its presence on the Web. Social media accounts are public and are not hosted on Obvi’s servers. Users who choose to interact with us via social media such Facebook, Twitter, YouTube, LinkedIn and others should read the terms of service and privacy policies of these third-party service providers and those of any applications you use to access them.

No liability

To the extent permitted by the applicable law, Obvi is not responsible for any direct, indirect, special, incidental or consequential damage or any other damage whatsoever and howsoever caused, arising out of or in connection with the use of the site in reliance on the information available on the site, including any loss of use, lost data, lost profits, lost opportunities, expenses, business interruption, personal injury or any other pecuniary loss, whether action is in contract, tort (including negligence), extra-contractual liability or other tortuous action, even if Obvi is advised of the possibility of such damages, losses, or expenses.

You expressly acknowledge that Obvi has entered into this Agreement with you and makes the site and each component of the site (including, without limitation, the Website Content) available to you, in reliance upon the limitations and exclusions of liability and the disclaimers set forth herein, and that the same form an essential basis of the agreement between you and Obvi.

Indemnity

You will indemnify and save harmless Obvi and its affiliates, and the officers, directors, employees, agents and representatives of each of them, (“Obvi Entities”), from and against any and all losses, claims, damages, actions, causes of action, costs and expenses that any of the Obvi Entities may sustain, incur, suffer or be put to at any time or times as a result of a third party claim or demand that in any way arise out of: i) the use of the site, and/or the Website Content; ii) your violation of any of the terms and conditions of this Agreement; iii) the infringement by you of any intellectual property or other right of any person or entity; and/or iv) out of anything done or omitted to be done by yourself, your servants, employees, agents, trustees, officers, subcontractors, or members relating directly or indirectly to this site or the Website Content.
